			<content:encoded><![CDATA[<p>Canada - The City of Toronto is facing a $300 million class action lawsuit from a group of residents who live near the site of a large propane explosion.  The suit claims the city was negligent in allowing gas plants to operate in a residential area.</p>
<p>The suit comes after an explosion occurred at the Sunrise Propane Industrial Gases plant over the weekend, damaging several homes.  The plaintiffs hope to recover damages for the cost of repairing their homes as well as emotional distress.</p>
<p>The litigation could bring on policy changes regarding the construction and placement of propane facilites in residential areas.  The plaintiffs&#8217; attorney hopes that all levels of government will take notice.</p>

			<content:encoded><![CDATA[<p>London- The parents of a 4-year old girl in England are suing the hospital she was born in for 300,000 pounds (that is $585,000 U.S.) for negligence.  The child was left with a disabled should after hospital staff pulled too hard on her when she became stuck during delivery.</p>
<p>The nerves in her neck and shoulder were allegedly damaged, resulting in the condition Erb&#8217;s Palsy.  The suit is for medical negligence, claiming that the injury could have been avoided if the staff had handled the situation appropriately.</p>
<p>Due to her condition, the little girl suffers permanent physical disability.  After undergoing physiotherapy her strength and range of motion improved.  At this point however, further improvement will not take place and her condition could deteriorate.  The suit also claims that her quality of life in the future will be affected.</p>

			<content:encoded><![CDATA[<p>Milwaukee- A four month old boy was found dead inside the day care SUV that picked him up last Thursday morning.  The driver of the Kuddle Kare Day Kare vehicle has been called in the state district attorney&#8217;s office for questioning.  Police are still deciding whether to file charges against the woman who picked up the baby at 9:15 in the morning.</p>
<p>Another employee noticed the infant in the vehicle after 3 in the afternoon and called 911.  The boy was found dead at the scene. The day care received citations last week for &#8220;premises not in good condition.&#8221;  It was also cited in March for having unqualified workers.  A spokesperson for the Illinois Department of Children and Family Services said the department has suspended Kuddle Kare&#8217;s license and will revoke it.  The day care will remain closed until the police and department have finished investigating.</p>

<p> <![endif]--><span></span>Cape Cod district attorney Michael O’Keefe is pushing for the criminal indictment of Dr. Rapin Osathanondh, after an abortion he performed resulted in death.<span>  </span>The doctor allegedly failed to monitor his 22-year-old patient after putting her under anesthesia and then hesitated to resuscitate the young woman after she stopped breathing.</p>
<p class="MsoNormal">Doctors do not typically face criminal charges when their patients suffer injuries due to medical negligence.<span>  </span>However, an indictment was handed down after an investigation by police and the Massachusetts Board of Registration in Medicine found Osathanondh’s conduct to be “willful, wanton, and reckless.”<span>  </span>The terms willful, wanton and reckless establish criminal intent.</p>
<p class="MsoNormal">During a state investigation, Osathaliednondh lied about his action and the equipment he had available.<span>  </span>“Suffice it to say, there was an inattention to the kinds of procedures of a lifesaving nature that one would expected in a place where an operation with anesthesia is being performed.<span>  </span>There was nobody monitoring her, long enough to result in her death,” said O’Keefe to the Boston Globe.</p>

<p>The <a href="http://kenoshapersonalinjurylawyer.com/article_drowning_statistics.aspx" title="drowning" onclick="javascript:urchinTracker('/outbound/article/kenoshapersonalinjurylawyer.com');">drowning</a> was ruled accidental by the coroner&#8217;s office and the medical examiner has said that alcohol was not in the victim&#8217;s system at the time he died. The full toxicology report has not been released.</p>
<p>The lawsuit alleges that the park&#8217;s management was at fault because they did not keep the water clear enough to see the bottom of the pool. The victim&#8217;s body was found in water about 12 feet deep. In addition, the lawsuit claims the lifeguards were not attentive enough to all patrons.</p>

<p>The little girl was going up the escalator in her Crocs when the Croc became stuck in the side of the escalator. This, in turn, trapped the little girl&#8217;s foot in the escalator. She was stuck for 15 minutes before rescue workers could get her out of the escalator. Following that ordeal, she was rushed to the hospital where it was determined that she had numerous broken toes and a &#8220;dirty cut&#8221;. The dirty cut was not just an ordinary cut as it had been contaminated by elevator grease.</p>
<p>Because of her injuries, the little girl has to spend 3 weeks in bed.</p>

<p>The man, who was represented by Daniel Rottier, suffered undue pain following an injection designed to prevent his back and other muscles from spasming went wrong, was given $5 million for pain and suffering. He was injured when a drug that was not meant to be administered in the spine was injected with the correct medication. The injury resulted in increased back spasms as well as in him requiring multiple surgeries.</p>
<p>The victim was diagnosed with multiple sclerosis (MS) in 1988. His injury occurred just months before the legislature passed a law putting a limit on the amount a person can receive for pain and suffering.</p>

			<content:encoded><![CDATA[<p>A three year old girl who was hit by a car while attempting to cross a street has died from injuries sustained in the accident.</p>
<p>An eighty year old man was driving along Alaska Road when he hit the little girl. The child was taken to a Green Bay hospital where she later died.</p>
<p>The names of the victim and the driver have not been released.</p>

			<content:encoded><![CDATA[<p>An Aurora, Illinois mother settled her medical malpractice lawsuit for a reported $15.35 million.</p>
<p>The mother claimed successfully in her lawsuit that her son developed cerebral palsy and suffered mental retardation after the doctor assisting in his delivery unsuccessfully used a vacuum extraction device to deliver the baby. On top of unsuccessfully using the vacuum extraction device, the doctors reportedly did not perform an emergency C-section until after the baby&#8217;s heart rate showed he was in distress.</p>
<p>The lawsuit was settled with the hospital and the doctor more than six years after the baby was born.</p>
